THIS AGREEMENT GOVERNS YOUR PURCHASE OF PRODUCTS FROM TAN'S CANADA. ("Carpenter Tan Canada") USING THIS WEB SITE. READ IT CAREFULLY. NO OTHER TERMS APPLY. BY PLACING AN ORDER TO PURCHASE OR RESERVE PRODUCT YOU ARE AGREEING TO THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT PLACE YOUR ORDER.
"Order" shall mean any order for Product(s) placed through the www.carpentertans.ca/store web site for delivery to a Canadian address.
"Customer(s)" shall mean any person or persons placing an Order.
Entire Agreement:The terms and conditions herein may NOT be altered, supplemented, or amended by the use of any additional document(s) that purport to be an agreement of the parties. Any attempt to supplement or amend this document or to enter an order for Product(s) which is subject to additional or altered terms and conditions shall be null and void.
Order acceptance by TAN'S CANADA/Cancellation of order due to errors:All Orders placed by Customers shall be subject to acceptance by TAN'S CANADA. Placement of an Order by a Customer or receipt of an order confirmation for either from TAN'S CANADA does not constitute acceptance by TAN'S CANADA. Acceptance by TAN'S CANADA occurs for Orders when TAN'S CANADA issues a confirmation of delivery to the Customer. TAN'S CANADA is not responsible for typographical or other errors, including pricing errors, and reserves the right to cancel any orders resulting from such errors.
Warranties:With respect to TAN'S CANADA branded products, TAN'S CANADA makes no warranties except as stated in the TAN'S CANADA warranty cards included with Products or, in the case of optional extended warranties issued by TAN'S CANADA, such extended warranty documentation. TAN'S CANADA's responsibility for any warranty claim is limited to repair and replacement as set forth in TAN'S CANADA's applicable warranty statement. With respect to third-party (i.e. non-TAN'S CANADA branded) Products, such Products are sold by TAN'S CANADA AS IS. However, the third-party manufacturer or supplier of these Products may offer its own warranties, and you agree to look solely to such manufacturer or supplier for any warranty related claims. TAN'S CANADA EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, WHETHER ARISING BY LAW, BY STATUTE, BY COURSE OF DEALING OR USAGE OF TRADE, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABLE QUALITY AND FITNESS FOR A PARTICULAR PURPOSE. Third-party warranties, if any, for software are contained in the license agreement that accompanies the software. This warranty gives the Customer specific rights and the Customer may also have other rights which vary from jurisdiction to jurisdiction. Some jurisdictions do not allow the exclusion of implied warranties and conditions. Therefore, the foregoing exclusions may not apply.
Purchase Terms and Conditions
General: The following terms and conditions apply to your online purchase through TAN'S CANADA. Please print a copy of these terms and conditions for your records. Furthermore, please print a copy of the terms and conditions with each purchase that you make, as TAN'S CANADA terms are subject to change without notice at TAN'S CANADA's sole discretion.
TAN'S CANADA knows that you want to receive your order as soon as possible, and we make every effort to get your package to you promptly. Please read the following payment and shipping terms carefully, to minimize the possibility of delivery delay.
Please be advised that there are no exceptions to the terms and conditions set out below. TAN'S CANADA reserves the right to cancel orders and refund any purchase price paid (as applicable) if any of these conditions are not met. Our mandate is to provide a safe online shopping experience for you. For example, our required credit card verification procedures have been implemented in order to protect you from fraud.
TAN'S CANADA sells and ships products only within Canada.
Engraving: Customers are required to thoroughly review the content of engraved messaging. TAN'S CANADA is not responsible for typographical errors and engraved product cannot be returned for refund or exchange. The 30-day returns period for regular products does not apply to engraved products. In the event you have a service issue, please contact the telephone number listed on your warranty card; do not ship the product back to TAN'S CANADA.
Engraved messages will be reviewed and are subject to TAN'S CANADA's approval prior to engraving. Inappropriate or derogatory messages, including vulgar language, racist and sexist remarks, will not be engraved. TAN'S CANADA holds in its sole discretion the right to reject any engraving requests.
Products must be individually opened and handled during the engraving process. As a result, orders with products to be engraved will take longer to process and are not eligible for express shipping. Estimated ship time will be 5 - 7 days following order placement and acceptance.
The limited warranty on the product does not cover re-engraving. In the event your engraved product receives service under TAN'S CANADA's limited warranty or any extended service plan offered by a third party, installation of necessary replacement parts may eliminate the engraving on the product. In such a circumstance, TAN'S CANADA will not re-engrave the product.
Payment Method: TAN'S CANADA accepts payment via MasterCard, Visa and American Express credit cards issued by a Canadian financial institution only. In addition, TAN'S CANADA accepts payment via PayPal systems. Cash, debit cards, COD, purchase orders or personal cheques are not an accepted mode of payment.
The cardholder must be the one who places the order. An order cannot be placed on behalf of anyone else. If a Customer uses a company card, the Customer's name must also be listed as a cardholder on the account.
Payment Terms: TAN'S CANADA will pre-authorize the Customer's credit card upon submission of the Customer's Order, and charge the Customer's credit card at the time of shipment of the purchased Product(s). The amount charged will be the full amount of the sale price of the Product(s) being purchased, plus taxes and any other charges required by law, plus any applicable shipping costs. Taxes, together with any other charges required by law will be charged based on the Customer's shipping address.
TAN'S CANADA is not responsible for any fluctuation in the Canadian Dollar exchange rate. TAN'S CANADA will always charge credits cards in Canadian Dollars.
Credit Card Verification:Upon placing an Order with TAN'S CANADA, the Customer's billing address will be verified with the bank issuing the Customer's credit card or with applicable credit agencies.
The Customer's billing address must match the address currently listed as the primary address for the cardholder, as evidenced by the issuing bank's records or the files of the applicable credit agencies. As stated above, TAN'S CANADA will verify this information. TAN'S CANADA reserves the right to refuse an Order and/or reverse the payment or pre-authorization of the purchase price, without notice to the customer, if the information provided to TAN'S CANADA by the customer is inconsistent with information verified with the issuing bank or applicable credit agencies, or if TAN'S CANADA's payment and shipping requirements are otherwise not met.
TAN'S CANADA Care Terms & Conditions
All wood products, by nature, are sensitive to moisture. Please keep the product in a reasonable store condition if not wearing, such as18 to 25 degrees celsius and moisture level at 40% to 60% if possible.
TAN'S CANADA are only responsible to products sold by TAN'S Canada (Carpenter Tans) retail stores or online stores managed by 8111987 CANADA INC.
